The Spousal Open Work Permit (SOWP) provides inland sponsorship applicants with the opportunity to work while they wait for their immigration application to be processed.

You get to work in Canada while you wait

With the SOWP, you can stay in Canada and work while you wait for your immigration application to be processed. The spousal sponsorship application takes about 12 months to process and during this time, if you are applying for permanent residence from inside Canada, you can apply for the SOWP to work while you wait for application approval.

You gain Canadian work experience

If you have the SOWP, you can work in Canada and gain the necessary Canadian work experience that will help you pursue and grow in your career even while you wait for decision on your immigration application.

You can work anywhere without a LMIA

The Labour Market Impact Assessment helps the employer show the Canadian government that there is no Canadian citizen or permanent resident available to fill up a job position that is why they are hiring a foreign worker to fill up the job position.

The LMIA document is issued by the Employment and Social Development Canada (ESDC) to the employer after assessing the situation.

With the SOWP, you don’t need a LMIA as the work permit will allow you to work for any employer in Canada and also work anywhere in Canada.

You can live with your partner

The SOWP offers you the opportunity to still live in Canada while waiting for your immigration application to be processed and so you can live with your partner while waiting for decision on the spousal sponsorship application.

How To Be Eligible For SOWP

The inland sponsorship is for spouses and common-law partners who are already living together in Canada. The person that is being sponsored must already have temporary status in Canada as a worker, visitor and student.

For you to get a spousal open work permit, you must meet the following requirements:

  • You must submit a permanent residence application under the Spouse Common-Law Partner Class
  • You must have a Canadian citizen or permanent resident spouse or common-law partner who has submitted a sponsorship application on your behalf.
  • You must live at the same address as your sponsor
  • You must have a temporary resident status in Canada or an approved application for restoration status with authorization to work

For those that are applying from outside Canada, you can apply for the open work permit at the same time or any time after you apply for permanent residence through the spousal sponsorship.

If you already received approval in principle on your permanent residence application, you can apply for the SOWP online.

The approval in principle means that the spouse or partner has received a letter from the Immigration, Refugees and Citizenship Canada stating that they meet the permanent residence eligibility requirements but they have not yet passed the medical, security and background checks.

The SOWP can be extended if the immigration decision has not been made before the work permit expires, so the SOWP holder will have to apply to extend their permits before the expiry date.
